According to the lawyer Julien Fouray, .... the health authorities "did not play their role of supervisory or regulatory authority,

He could be charged with criminal offense, influence peddling, corruption and misuse of corporate assets.


The plaintiffs therefore also target the state and the ANSM (FDI in France), for endangering the lives of others and manslaughter (due to patients' suicides),

I have said for years, and still maintain, that until we hold the US government liable for causing the modern spread of Lyme disease, none of us will get well. But my position is opposed by even those in the Lyme movement.

No necessary change has ever come from being silent. No change or cures will be found because the US government will not want the cost of liability by admitting it caused the modern spread of Lyme disease.

So our French counterparts are exactly right: Accusing their government of complicity in causing or maintaining Lyme disease.

Lets learn from these brave people: J'accuse the US government for causing the modern spread of Lyme disease and keeping us sick. Admitting the truth exposes the government to billions of dollars of liability.

Truly, the truth will set us free!

Appeal from 2 health professionals who helped lyme patients illegally

Two health professionals are on appeal on Friday.

They are being prosecuted for implementing alternative methods to detect and treat Lyme disease.

... opened on Friday (October 7th) in Colmar, against a backdrop of ongoing controversy over the management of this disease which is transmitted by ticks.


One of the two defendants, Viviane Schaller, 68, is reproached for having, in her laboratory of biological analyzes then located in Strasbourg -

... and now closed, on decision of the health authorities -,

... applied for years a unapproved disease screening protocol.

According to her, official protocols are inadequate and only detect a very small proportion of Lyme cases.


His co-founder, Bernard Christophe, 67, is being prosecuted for manufacturing and marketing outside the regulatory framework a remedy based on essential oils against Lyme disease, called "Tic Tox".

V. Schaller is condemned, B Christophe is dead

December 2016


Suspected to have interpreted the results of a screening test to make the second still necessary, and to have defrauded the CPAM (primary health insurance) to the tune of 280 000 €,

.... the biologist Strasbourg Viviane Schaller has seen her sentence confirmed.


As in the first instance, she received a nine-month suspended prison sentence and will have to pay € 280,000 in damages to CPAM.


At the end of the deliberations, her lawyer Julien Fouray immediately announced that she was going to file an appeal on points of law: "Her fight continues".


For having marketed a product based on essential oils of plants, considered by the law as a drug sold without authorization, the Bas-Rhinois Bernard Christophe had been sentenced in first instance to nine months suspended,

... and to pay 10,000 € of damages and interests to the council of the order of pharmacists.


The Strasbourg court had nevertheless found that he had not been complicit in a scam.

Bernard Christophe died on December 10 of a cardiac arrest, at the age of 67, the court found the extinction of public and civil actions, and thus the cessation of legal proceedings.


"Bernard Christophe was not a crook, on the contrary, he fought for the patients of Lyme for nearly 20 years," said Wednesday his lawyer Me Catherine Faivre.

Elisa laboratory sued by 45 patients in October 2016

On Monday, October 17, 2016, BioMérieux laboratory, manufacturer of the Elisa test, the main test for Lyme disease,

.... announced that it had been sued by 45 patients.

They were asking for compensation for anxiety that was "made by the lack of reliability of serology of diagnostic tests of Lyme disease", said BioMérieux in a statement.


Grouped together in the Lymaction group, these patients are defended by the lawyers Catherine Faivre and Julien Foyray

... who announced on October 18, 2016 launching a "first wave of appeal that obviously announces others".

Today, Lymaction brings together half a thousand plaintiffs.

According to Julien Fourey and Catherine Faivre, the Elisa test would detect "only 30% of cases".

However, Lyme disease, transmitted by tick bites, can cause serious sequelae (neurological or joint) if it is not detected quickly.


BioMérieux, who was on the bench, claims that his tests "have always been and are now in compliance with European and American regulations".

It also considers "to have committed no fault and will oppose the requests of the assignment which the company considers unfounded in the state of the available elements".


The Lymaction also accuses the health authorities, the State and the Minister of Health of not acting in this situation.

Indeed, the state does not recognize the unreliability of the tests and has not yet classified Lyme as an official disease.

As a result, care related to the disease is not reimbursed.

Brussels: that is how the whole story of the action started.

By these first small group of 45 patients trying to sue an Elisa test lab, it grew to 300, now against state organs!

Now they plaintiffs aim the central government, because the State is responsible to allow such tests to be the ONLY acceptable standard for diagnosing lyme.

Thank you Tincup and Brussels for posting.

Talk about courageous, Tincup exemplifies it. And Brussels you and others probably do too.(my finger is not on the pulse of the Lyme movement my like it was and ought to be).

But I do think a new thrust and stronger approach are necessary in our advocacy to make substantial gains.

At the same time, I applaud everyone for any advocacy put forth on behalf of the Lyme movement. It ain't easy.

But if we persist, one day we will win.

The Criminal Complaint, this time, is against forced vaccinations.

The government says 11 vaccines are compulsory now, since this year 2018, for all new born babies.

In fact, there are exactly 73 shots, that babies receive in the first 18 months of life!!!

11 is just the number to look small: if you can read French, you'll understand that 11 compulsory vaccines in France MEANS 73 shots for newborn babies!!!!

They are asking the French to sign this complaint, they hired lawyers that know the law, people's rights etc.

I hope they'll gather enough signatures and file the complaint!!!!

How the government pushes doctors to force vaccinations under pressure

If you can read French, this is AMAZINGLY interesting.

French authorities recognize that there are more and more people RESISTING vaccines.

More than 50 % of people start thinking there may be some lies involved, and are suspicious!!!

It's in one of the French newspapers, in this link above.

So, like in a WAR, this slide presentation AIM is to push doctors to convince the fraction of the population that are has doubts about vaccine.


the CONTRA vaccine: they do not aim these, as they are informed, no way to convince them!! [Wink]

The French government then is teaching strategies to CONVINCE such parents, the ones who are a bit suspicious, but not totally.

How to prove vaccines have no side effects, how the danger of disease win against whatever damage.

It's a golden document, to be kept somewhere. That is what happens to lyme too, how the doctors get information about treatment, how they should proceed or they may get punished, how they homogenize treatments to the population.

One single document, that's all, and repeated fake information, including penalties for doctors if they do not obey...

The pharma is behind, for sure, you feel that at every line.

but they are AFRAID, I can sense that in the text. Resistance is growing!!!

In the slide presentation above, specifically destined to brain wash doctors, with menaces, sanctions, etc...

... the French Ministry of Health wrote in the conclusion of the document, page 91:

THERE IS NO STUDY PROVING THE TOXICITY OF ALUMINUM!!!

She said, this is a French invention.

International studies show that there is absolutely no toxicity of Aluminum nor of vaccines.

She also criticizes the actress Isabelle Adjani, who thinks vaccines are dangerous.

She proposes that in the future, such comments against vaccines will be punishable by law.

I'm coming late to the party here -- didn't notice this topic until just a few days ago, because I don't visit Lymenet on a regular basis anymore these days -- too busy with our TxLyme Yahoo group. Nevertheless, I can't pass this topic up because this is a subject that I studied in great depth about 15-20+ yrs. ago.

I have a document in my files from the US Senate Appropriations Hearings for the Dept. of Defense for 1969 -- available in the documents section on microfiche at our state university library. The late Sen. Edward Kennedy was Chairman of that Budget Committee.

In it, the document mentions both insect-vectored diseases and also aerosols. It also mentions that they were seeking both lethal agents and incapacitating agents. At the time, we interpreted that to mean AIDS (deadly) and various aerosols containing mycoplasmas infected with viruses.

I also have documents in my files about the testing of "flu vaccines" on death row inmates here at our state prison back in the late 1960s through the 1980s.

It was all done legally, under the guise of flu vaccines, for which special federal legislation was passed.

These documents were taken from the Board Agendas and Minutes of the Texas Department of Corrections back in the late 1970s and early 1980s. Later, those documents went missing when there was an "accidental" fire that occurred overnight at the state prison headquarters.

I also found corroborating documents in the TAMU Medical Library about those aerosol experiments, with acknowledgements thanking the US Dept. of Defense, and which were supervised by medical researchers from the Baylor College of Medicine in Houston who were the authors of those papers.

These were the same doctors who had come down to Texas in 1968-69 from the University of Maryland, just outside of Wash. DC, where the DOD had first started their biological warfare (BW) experiments.

We learned several years later that the Nobel Laureate, Dr. James Watson was often down here in Texas, to visit and to supervise these "flu vaccine" tests on our death row inmates because one of the nurses saw photo of him in Time Magazine and recognized who he was. He had a special pass to enter and leave the prison through a back door so that he didn't have to sign in as a visitor at the front gate!

There was an outbreak of ALS among the prison guard personnel which spread out into the larger community -- over 2 dozen deaths from ALS during the period of about a decade -- but it was all covered up with voo-doo epidemiology.

This was a small community of fewer than 35,000 residents, but the epidemiologists intentionally expanded the surveillance area to a much larger geographical area and which included many more people in order to conclude that there was nothing unusual about this outbreak of ALS.

Yes, I know about the nonsense that went on at Plum Island, too, at the Animal Experiment Lab there, but I'm convinced that that we primarily incompetence and budget mis-management which allowed the accidental escape of insect-vectored pathogens for lack of funds to insure bio-safety measures to prevent it.

You can read about the mis-managemnt of Plum Island in the book by -- Aw shucks! I've misplaced that book and I can't think of the title nor the name of its author right now, but perhaps someone else will remember it.

(The author's name might have been Robert Carroll, or something close to that. The title might have been Lab 257, but that book might be about Japanese BW instead. My memory of these books is very vague now because it's been so long since I looked at any of them.)

That book explains how the escape of pathogens from Plum Island was the result of mismanagement and lack of sufficient funds from Congress to provide for adequate safety measures during major storms which caused electrical outages during those storms--rather than any kind of deliberate release.

Incidentally, I do believe that West Nile Virus was a deliberate release ca. 1996 though, in order to justify Plum Island's request for more budget funds from Congress -- and perhaps also to measure the spread of a supposedly innocuous mosquito-vectored disease which was new to the Western Hemisphere. (MOO = my opinion only.)

I find the previous explanation to be very believable -- that it was NOT a deliberate release of pathogens from Plum Island which was responsible for the spread of Lyme arthritis, but that it was the result of simple incompetence and budgetary mismanagement which led to the outbreak of Lyme arthritis in Old Lyme, CT -- and eventually its spread into the Hudson River Valley area of NY.

Also, there's one other book by Rachel Vernon (or maybe Verdon, or some name similar to that) titled "Lyme Disease and the S.S. Elbrus" which is a fantastic read. It discusses how Lyme-infected ticks entered our country at three ports of entry -- Portland, OR; the port down in South Texas (Port Arthur, I think) and through the port at or near Philadelphia.

These infected ticks were carried in on fur pelts on Russian ships because no one in Europe would buy these infected fur pelts. My memory of this aspect of it is a bit vague now, but this is reasonably close to what the book is about.

It's been a very long time since I read that book, and it's lost in the same box with the other book, discussed above. I don't have time to search all of the boxes of books in my garage right now because we are leaving town for Spring Break early tomorrow.

If I can remember and if I have time after I get back home again this weekend, then I'll try to look for those books and either edit this message to include those book titles, or else add a separate new message to this topic -- but no promises about doing that because my life is super busy with some other really important Lyme-related projects here in Texas, which have an up-coming deadline in the very near future.

There's a whole lot more that I could say on this subject if I had more time to say it, but this will have to suffice for the time being.

Besides, the moderators might not like the direction of this topic and they might decide to delete these remarks, and that's another good reason that I'm reluctant to spend any more time writing about it right now.

IMO, the above is the only explanation of why the Lyme issue became politicized in the 90s and science stopped becoming the driver for advancement and the why the CDC started obfuscating and not working with the Lyme community. Nothing else makes any sense and it explains why this disease is treated differently than any other disease in the history of mankind.

My take on it is a little bit different than that. I can recall that AIDS was in the headlines, starting in about 1983 and that Chronic Fatigue was in the headlines, starting in about 1984. AIDS was deadly, so it got all of the funding.

The NIH and the CDC were worried that we had a very expensive public health crisis on our hands with AIDS which could wreck the national health care budget, so it made good sense to them to label CFS as being caused by a putative virus-- since everyone knows that you can't treat viruses with antibiotics, pure and simple.

Even if TPTB did suspect that CFS might actually be caused by a spirochete, which Willy Burgdorfer identified in 1982, they weren't about to admit it publicly since no one knew how to treat it, especially after it had become chronic.

Thus, it was cheaper simply to sweep it under the rug and to feign ignorance about this possibility than to admit it publicly that it might be bacterial in origin.

The interesting thing though is that CFS was housed in the Division of Spirochetal and Rickettsial Diseases at the NIH, if I recall correctly. I think that they even put it into a division for Allergies, as best that I can recall.

What else is even more interesting is that the website address for CFS was somehow connected to the DOD (Dept. of Defense). I wish I could still find that old NIH publication about CFS which shows this DOD website address.

I know that I saved that old pamphlet, but finding it again amongst boxes and boxes of old files would be a minor miracle for me by now.

I can recall giving public testimony at a CDC/NIH-sponsored public event in Seattle, WA back ca Jan., 2001, in which I brought some of these details to light during my brief 5 minutes of oral testimony.

My written testimony was even posted on the CDC website, briefly, for a few months, but then 9/11 happened and TPTB very wisely removed my written testimony from their website -- much to my great relief, because I had included links to documents incriminating the US in biological warfare (BW).

I'm pretty sure that I still have a copy of that written testimony in my files somewhere, but I'm not at all sure that I can lay my hands on it again now -- although I'd dearly love to find it again so that I could refresh my memory of those events.

I know that I was already aware of Lyme disease by then because our daughter was diagnosed with Lyme in 1998 (having been infected by a tick bite in 1973), but my main interest in BW at that time pertained to mycoplasmas and viruses, not to spirochetes. I had boxes and boxes of files on that subject.

And that, my dear friend, is ALL that I can remember about any of it now -- unless I get lucky and remember where to look for some of it , 'cause I know that I saved the most important items in a very special filed. Maybe they'll turn up soon if/when I have a little free time to search harder for them.

Oh, I do remember one more odd detail about being on the telephone with the late Dr. Lida Mattman, PhD, who did the original research on culturing the cell wall deficient form of Bb, when she told me to hold the phone and to call 911 if she didn't return immediately.

She explained that someone had threatened to kill her if she didn't stop her research, and she was worried because she had heard a noise and she thought that someone might be breaking in on her home laboratory -- because she was retired by then, so she worked at home.

We were all a little spooked back then about things like that. It's funny how easy it is to forget these events now because there has been so much water under the bridge since those earlier days.

Another better accepted explanation than the one that I wrote about in my previous message is that the early Lyme researchers all took out patents on Lyme vaccines which they had hoped would become very lucrative for them personally. Much of the obfuscation stems from their greed.

This scenario has been exposed in the documentary film "Under Our Skin" and in its Part 2 sequel by the same title (I think?).

I wish that I could give more exact details, but I've tended to focus most of my attention and research on finding answers for sick members of our TxLyme Yahoo group.

That's why I simply don't have time to dally around with conspiracy theories -- no matter how true and non-trivial, I suspect that these BW conspiracy theories could really be.

TX Lyme Mom - the book about Plum Island you are referring to above is Lab 257 by Michael Carroll. Animals with ticks on them kept in open-air pens, birds swooping down on them, getting ticks on them, and flying everywhere. Also a hurricane which blew the roof off once, I recall. Lots of experiments done with ticks and bugs, not just Lyme.

Thanks, Robin. I was hopeful that someone knowledgeable would come along and fill in the missing details for us.

These details are important in order to lend credibility to this seemingly unbelievable "conspiracy theory" -- especially for those persons who are unfamiliar with the history of Lyme disease or those who would seek to deny its existence and/or its severity.

BTW, does anyone know where to find a link to the class action civil suit which was filed in district court in Texarkana, TX last Dec., 2017?

I thought I had bookmarked it because it can be difficult to find otherwise, but I've lost track of it.

For those who are unfamiliar with it, this class action civil suit alleges corruption charges based on two US federal laws -- namely US anti-trust legislation and also US racketeering laws. Definitely NOT minor or trivial charges!

These two charges are well documented within the law suit which was filed in US district court. Texas is in the 5th District, which is ultra-conservative, BTW, which is where it will end up, upon appeal, which is inevitable, considering the important and contentious nature of this case.

The approx. 23 plaintiffs represent something like 17 different states of residence, but I can't recall these exact details because I don't have the court document in front of me right now since I've misplaced it. TIA for anyone's help in posting a link to it.
