Please see Karla's post here:

http://flash.lymenet.org/scripts/ultimatebb.cgi?ubb=get_topic;f=3;t=034628;p=0

It gives link so everyone in any state or country can write the governor, ask him to sign. If you wrote before, you can write again. We only have 9 days left before the deadline. He has now been sent the bill from the legislature to either sign, veto, or let it become law without action.

Please keep this thread near the top for the next week.

Up, URGENT!!!

NY has many of the very best LLMD's in the country, and they are ALL being investigated----some for the third time! And this has been going to this degree for about 5 years!

So most don't dare rx IV's much, if at all, for instance.

Grrrr! Please do this, especially if you are in NY State.

[Mods: Please, please leave this in Medical. If he doesn't sign this in the next few days, it will be very, very bad for NY. And the precedent will be set for all the other states, too.}

Thank you!

Only two days left, if that! Cuomo has to make up his mind by Wed., the 17th!!!

NYS residents, please use:
NY State Doctor Protection Bill

Add at least one sentence of your own here, such as:

I am concerned because I (or my child, or friend) have Lyme disease, or I was turned away by (how many) doctors, or I waited (how many) months for an appointment, or I had to travel (how) far (or out of state) to get to a doctor, or any other hardships you can think of a result of so few doctors being willing to risk their licenses to treat Lyme disease.

Residents of other states can use the sample letter from the previous link and the governor's contact form here: NY State Doctor Protection Bill

There have been 2 HORRRIBLE articles, one on Slate, and one at Forbes, each couching it as this is a terrible bill that gives cover to quack doctors for a non-existant illness!!! (Those articles also need to have a lot of responses, too).

So that is what we are up against, in addition to the IDSA Guidelines authors, many of whom are in NY State! They are lobbying hard for him not to sign it, or to water it down.

[Mods: Please, please let this stay up in Medical until the end of the day on Wednesday. This is so, so critical, and it is NOT a slam dunk at all. ALL of the LLMD's in NY have been investigated heavily for the last 5 years, many of them for the 3rd time!!

Many people come to NY LLMD's from all over the country and all over the world. They cannot rx as they would like to at all as a result of the constant investigations. Plus, if this bill isn't signed as is, that bodes ill for other states to follow suit.

Thank you!]

Governor Cuomo’s Approval Message
APPROVAL MESSAGE:

APPROVAL MEMORANDUM - No. 27 Chapter 532

MEMORANDUM filed with Senate Bill Number 7854, entitled:

"AN ACT to amend the public health law, in relation to the identification, charging, reporting and investigation of charges of professional misconduct by health care professionals"

APPROVED

This bill would prohibit the Office of Professional Medical Conduct (OPMC) from identifying, investigating, or charging a licensee based solely upon the recommendation or provision of a treatment that is not universally accepted by the medical profession, including but not limited to, varying treatments used in treating Lyme disease and other tick-borne diseases.

I support the intent of the bill, which would further ensure a patient's ability to seek a non-universally accepted treatment as well as a practitioner's ability to exercise his or her clinical judgment when recommending such treatment. However, the bill, as passed, contained certain technical and implementation flaws that would limit OPMC's ability to conduct an inquiry or investigation into a certain category of complaints thereby putting the public at risk. The Legislature has agreed that this issue is important and has agreed to a chapter amendment that addresses it while maintaining the integrity and original intent of the bill. On that basis, I am signing the bill.

The bill is approved.
(signed)
ANDREW M. CUOMO
