The local school district had been denying my son an IEP based on my son's academic status. I have been told repeatedly he is an A/B student and doesn't qualify, even under other health impaired. I filed a complaint with the state and they have ruled the local system negligent in not assessing all areas of disability to include health issues, behavioral and assistive technology issues.
The local system must provide another meeting for him within 30 days. They also have to show the state documentaion and set up a tracking tool that all kids are being evaluated correctly.
I have an advocate going with me to the meeting this month who is a recently retired teacher who dealt with these issues in her district, which is considered one of the best of the state.
The local district will have to provide whatever services are necessary in helping Nathan catch up with his peers for next school year. He was tested as having significant weakness in all areas of academics.
As you can tell I am excited!!! Asking for all the prayers out there for us in this situation.

Let me tell you, the school system will fight you the entire way until graduation.
It was absolutely crazy, the things they came up with.
They tried everything, most of my sister's teachers had no idea what was going on (for several months, the teachers thought my sister had dropped out. The teachers were SUPPOSED to be giving my sister make-up work at the time and we kept complaining that the make-up work was never in the office to be picked up. Well, the teachers had no idea that my sis was supposed to be getting work at all). They would make inconvenient times for meetings hoping we wouldn't show up or they would cancel at the last minute (or not show up at all). They tried so many things and used so many excuses.
This went on her entire 11th and 12th grade.
Good luck and don't stop fighting. That's what my father and I did. My sister graduated on time, with her class.
