How many of you have had work disputes? Been denied disability pay and getting the cold shoulder. This is my case. Had to appeal the decsision despite having documentation from 4 Doctors. Any recommendations to what I should do to get things solved.I use to love the company I work for, but now I have no respect for the way things have been handled. How can a medical director 2,000 miles away make a decision like this who has never examined me and has disregarded everything my doctor's( Lyme's specialist,Primary Doc., Pychiatrist and Pychologist) has documented about my condition? ****ed off in Conecticut. [Mad]

Yes, unfortunately it's done a lot.

I was lucky in receiving LTD when I had to stop working. [Big Grin]

I applied for disability retirement, and went all the way to the top with appeals.

They based their denial on a less than 45 minute appointment with a psychiatrist, and ignored about three inches thick of documentation of my disabilities and medical records. [dizzy]

I also had a hearing and had fantastic phone testimony from a neuropsychologist, who was the reason for my SSDI approval.

So the US says I am unable to perform any job, yet the state still says I can teach school. Go figure! [loco]

The county did a separate evaluation and concluded I was eligible for disability retirement. [Big Grin]

You may want to look into finding a good ERISA attorney. Check with local support groups for names,

Yes- it is really important to get an appointment with a neuropsychiatrist who gives you cognition testing at least from what people in my local group say- I didn't go on disability but was unable to work and then went back to work full time- you can get disability for lYme but often it is easier getting it for one of the manifestations like CFS!! sad but true!!

It's amazing how a good worker like myself is treated with such respect until they find out I'm have an illness like Lyme's and then their attitude changes so quickly. If I return to my job, I can't see how I will ever be able to hold my head up again.How can a company deny a worker who has 4 doctors submitting documentation to explain my inability to work, Short-term disability pay. It's not right. In the mean time I'm accruing unexcused absences. Can I sue for wrongful termination if they let me go?? No money for a Lawyer. Will one take a case only if they win? Please help.

Get a lawyer who specializes in this area. This could be the most important thing you do. I got one after starting to have problems with being able to work at full capacity. He documented all of my correspondences from my doctors and my e-mails to my managers explaining my situation.

I would follow up all my conversation with my managers by e-mail. This leaves a paper trail that covered my butt. After my visit with my lawyer and getting some of this paper trail started, he said I was safe, if they tried to fire me or refuse to give me the dissablity that he would take it to court and we would have a great case.

This was the best investment I ever made. It was not that expensive either. I did have to leave work due to not being able to work and I had no problem getting the leave that was entitled to me under my emplyoment.
