Hi everyone, My question is My LLMD put me out on fmla, my 12 weeks is up on 8/28 and I will not be returning to work.
Lincoln is my disability carrier, they paid me for six weeks then cut me off.
I have the right to appeal, but can I still appeal after 8/28, I will be terminated at that point.
Do I still need to pay premiums to Lincoln? Has anyone else delt with Lincoln?
I have heard they are a nightmare, now I am about to find out.

I would call them, take down the name of the person you speak with, and after you get an answer to your question, ask that person to send the response to you in writing for your records.

Thanks For your replys, I contacted an Attorney,
I meet with him On Thursday, He said I have a good case, he also said Lincoln is a bad company
to deal with, they LOVE to denie claims. So here I go, Im sure it will be a long process, but worth
it in the long run. Im just not going to let them get away with it. thanks

If you went out on disability in late May, then why are you on long-term disabilty already? Seems like you should still be on short-term disability?
Did Lincoln send you a letter notifying you they are ending your benefits and why? A disability company can't just cut you off without giving you a clear reason.
Often the insurance company will claim they don't have sufficient "objective medical evidence" of your disability. If that is your situation, you could appeal yourself by asking your doctors write letters detailing your symptoms (including the severity and frequency of your symptoms) which prevent you from being able to work.
Sometimes it's even simpler than that, and all the insurance company needs is updated office notes and lab results from your doctors.
Since you've only been out on disability a few months, you can most likely appeal without giving an attorney a 30-50% cut of your future benefits.
The Disinissues website and discussion forum on Yahoo are great resources for disability issues.
If you haven't already, do your homework before signing any contract with an attorney.

Thats when they ask for more information from my doc. He did the paper work they requested, but then denied my benefits.
My letter states that.. my claim does not support total disability as defined by the policy.
Im wondering if it could be the way my doc. wrote the letter? maybe he was not discriptive enough.
I have no experience in dealing with disability, so any advice you can give me would be helpful.
