I received an email Friday letting me know that CALPERS Industrial Disability is in review.

Review is 30 to 60 days.

I do not know when it went into review.

My hope and pray is that I will be approved.

We had several of us at work come down sick in Oct. 2001 with the same symptoms. I seem to be the one it hit the hardest.

One was dx with valley fever and then CFS. She had previously been dx with fibro but was able to work until Oct. 2001. She was approved for CALPERS Industrial Disability and is waiting on workmen's comp.

She came down sick 2 weeks before I did.

The other was dx with fibro brought on by stress at work. She was approved for both workmen's comp and CALPERS Industrial Disability.

I have lost contact with the others who came down sick. We all worked in the same area.

It would be such a relief if this was approved. I would have more resources to help me improve.

I do believe this is work related.

i hope they approve this for you.
remember what i said about "bad faith"

well guess what dear,
after 4 years you definitely qualify for bad faith.

you should really speak to a lawyer at this point, because he may be able to get you much more money than you think you are entitled to.

mosts lawyers don't charge for intial
appointment
and with this case the penalties would includes lawyer fees, bad faith fees, could be several 100,000 dollars, plus penalties and interest.

did you apply for workman's comp.
if not you should, and will probably need the same lawyer.
he can make you a deal on the fee ,since the work is the same just 2 different places.

Thanks guys.

I did not apply for industrial disability at the beginning. I kept thinking I was going to get well and would be able to return to work.

I do not know how long it has been since I applied.

I do know I did contact an attorney who does handle CALPERS cases. HE said I needed a denial letter first before they can step in.

My prayer and hope is it will be approved first time around and not drag out any longer.

I did file for workmen's comp. I had an attorney and he helped by keeping the case open long enough for my brain fog to clear up enough to know he was not helping.

I have contacted other attorney's and they said at this late stage in the game they can be of no help. I would have a better chance of handling it myself.

I think the next step with it is for me to request it go back on calendar. Then, they will set a date. I need information for the judge to see that I need to see the AME...again..an independent medical examiner that I saw and have him re evaluate the case.

I really do not like the idea of going through all of these steps again, but will do it.

Having CALPERS approved will give me the funds to get to California.

I also need to the brains to come up with reasons I think the medical examiner needs to look at my case again.

I have copies of the symptom list from the LYME Times that I sent to two of the teachers who came down sick. I need to get those copies to workmens' comp so they can see our symptoms are the same even though we have different dx.

I need the funds to hire someone to help me with getting the files set up so I can find my paper work.

It have not been able to do this since I came down sick in Oct. 2001. I was good at organizational skills before this.

I have had people come in the past to help, but I find that not everyone has clerical skills.

It is difficult with all the medical paper work from lab results, workmen's comp, calpers, SSI, Blue Cross, Blue Shield, doctor's, medical bills, etc.

I have a box of papers alone from workmen's comp. Most of them are such bad copies, I do not how the medical examiner even came up with a conclusion. You can't even read the reports from docs.

Other reports have information on it that is not adequate and looks like a standard form they use for everyone and just fill in the family history and little about me.

I keep thinking that if I just took 5 or 10 minutes a day in that room, I could get the job done. But, most days my brain does not work when I am on my feet or sitting. I need to be reclining and limit the amount of brain activity.

I do feel I am getting closer to being able to do this. I do feel the ketek is helping with the brain stuff.

kam, where you live, do they have a SENIOR VOLUNTEER PROGRAM? our city does, and they offer all types of FREE help to folks.

if you have something like this, call them for assistance asking for secretarial help in organizing all your boxes of 5 yrs. of paperwork.

also ask them if they have any type of a lawyer who has offered to help folks as well!

you might be able to come up with a great FREE services by the local volunteers who used to work full-time doing these things, and now are GIVING BACK TO COMMUNITY!

It seems like I did call the senior center. But, I will add this to my to do list and hopefully call Monday.

I also will contact the local church I have been trying to go to and see if they might know of someone.

Good idea. Two heads are better than one. In this case...with lyme...sometimes we need more than two. HA!

Update:

I received a call from the manager of CALPERS yesterday.

She said my claim in in the final stages. She sent for something..

..It was a telephone conversation and I still miss a lot of what is beings said but am doing better.

...She said there were many other cases before me.

And she did not know when I would hear something.

She gave me her name and number.

It was good to finally talk to someone who is directly involved with the claim and to get the contact information.

It was all I could do to write the number down.

It is on a piece of paper with a magnet on the frig right now but need to find a place to record it where I will have it when I need it.

Need the skills to write it down somewhere.

Please continue to pray it is approved.

It was good to know where things stand with it.

As I am in the process of moving with the section 8 program and did not want to move and then turn around and move again.

If (when) CALPERS is approved...I am considering moving closer to my lyme doc as it is too much for me to travel.

So, it helped me know i was making the right decision for now.
