I got fired from my job for absences.(I worked there 1.5 years) I had my doctors write my employer notes throughout my employment stating I had a condition that had episodic symptoms where I was unable to work sometimes.

When they fired me I filed for unemployment and was disqualified because my previous employer said I did not have a compelling reason for being absent and never gave them a note.

I'm appealing this. What does everyone think about this??

Also, I'm turning 26 this November and will not be eligible to continue receiving insurance benefits (and prescription benefits!). What should I do??? How do I treat without insurance???

My doctors do not take insurance, but my blood work is done through insurance, and i wouldn't be able to take all the medicine I'm taking without insurance!!! AH.

APPEAL TO UE is Right! Do you have copies of the notes you gave to him? Or can you GET copies from your doctor? Do you have DATES you gave him the notes? (That may be enough!)

Do you have testing information? I know it's kind of personal but if you win an appeal and collect you could afford to KEEP your Insurance, under COBRA... google it!
(They are required to offer you 15 months of of your old insurance after leaving a job - it's called COBRA coverage, but you must pay for it!)

DON'T LET YOUR INSURANCE LAPSE! Even if you are fired they are REQUIRED to keep you on their insurance, as long as you give them a check WITHIN THIRTY DAYS of your Dismissal! Then pay monthly after that. Do the math - it will be worth it for you!

If your employer hasn't sent you a COBRA letter within 2 weeks of your dismissal, start BUGGING them for it! It's the LAW!

BTW, Appeals can be WON. Especially when the boss has a "history" of firing folks for no good reason ... UE has records, and they can spot a weasel. You just need to speak up with the Truth!

I think Lotus is talking about losing health coverage under her parent(s) plan.

Obama Care now makes insurers cover dependents or children until age 26.

I don't know if there is a Cobra option in this case. You would have to find out from the employer or insurance company.

The thing is, that to receive unemployment, one has to be ABLE to work, consistently.

Now, many of us were bounced to unemployment when we could no longer work and did the required weekly job search but flew under the radar regarding the inability to work.

If stated up front that you lost your job due to illness, that "a condition that had episodic symptoms where I was unable to work sometimes."

Whether or not your employer received or acknowledged receipt of such note, you are putting yourself in a rough position with unemployment insurance.

I know this is a sad interpretation but if receiving unemployment, you'd have to be able to work any day.

It's not the way it should be - as there should have been some protective aspect to your job for leave time.

Did you file a request for reasonable accommodation with the Human Resources Dept. at work?

If so, they would be required REASONABLE accommodation for schedule, etc. as long as the work still got done, somehow by you or others on the team.

If you declared a disability and requested accommodation, that affords some job protections.

But, if not formally declared with HR, there's little protection or flexibility.

Thank you so much everyone for you info and support! I am getting insurance under my mother's plan. (so when I turn 26 I guess I will have to look at an independent insurance company...or charity care??)

Keebler-- I was worried about UE seeing me as disabled. I don't know why but I am always soooo apprehensive about telling anyone I'm sick! My mom didn't think it was fair so we appealed. (sad Face). I don't want this to effect me negatively when trying to get another job.

Isn't it illegal, though, for UE to disclose this information to anyone else?

You're not disabled because you were TREATING ... which implies the expectation that you would get BETTER!

Good points Keebler, but this is a grey area as to UE - fact is, she reported her illness/treatment to her employer and he didn't respect that!

Even though you may not have taken the insurance your job offers, I think you MAY still have the right to get on their roles, after you are dismissed. Check into the COBRA laws, they likely have a website. If this is possible, guage which comes first, 15 mos. on COBRA, or your 26th birthday?

Failing that possibility, I believe the Affordable Health Care Act doesn't come into full force until 2014 - at which time folks who simply can NOT afford insurance, will be covered by Uncle Sam. (Likely some bare bones "Medicaid-like" policy that hardly any doctors will accept.)

can you apply for disability??// sounds like it..

not sure how the two work ,,,,,against each other or seperate..some lawyers take cases for disability without money,cause they would get a third ogf the back pay owed you once they got case through,,

they specialize in it..
my brother was in the middle of all that for years both ways and it was a fight..he got it 6 weeks before we lost him, cause no medical care ..hang onto insurance anyway you can...

can clinics by scale get you the basics.

I had my brother on one in Denver ,not knowing what they were teating ..
then he had to go to AR to retrieve belongings and got robbed, lost house, couldn't get medical help there and
i was to sick to get to him ...could just send money.........

Disablility takes a couple of years to get - even WITH a lawyer! It's an awful system!

I would go for the UE for unlawful dismissal (since she told her employer about her treatment and condition). She just needs to prove that.

BTW the only person who MIGHT be privy to your health information, should you disclose it, is your boss. He has a right to answer your appeal.

lymedisease.org has a program to help people to receive their antibiotics, if they don't have insurance or can't afford them.

I'll see if I can find the exact link and post it.

Apply for SSDI. It takes about 1 1/2 years, but it would be worth it to eventually have an income.

And if you get well in the meantime, you can still get backpay from SSDI, which could help you in many ways.

Does your state have a high risk/prexisting condition pool? Some states have special insurance available to those with pre-existing conditions.
