Well, today is the day our attorney is filing against the powers
That be in our local government who have done everything possible to keep us from building a new house.
I am scared, but in a way, glad to finally be able to take a stand to defend our rights.
Our first "trial" will be one based on the principle of madamus.
Just says basically that the local government has to follow the rules and regulations
That it has set up. (Didn't happen with us)
Our attorney continues to be shocked by how we have been dealt with.
Just hoping and praying for a resolution in our favor with the granting of the permit to build.
Our attorney has taken on the local government and never lost a case.
Hope to be one of the winners soon.
Then, maybe we can get on with our lives and on the road to getting better.

good luck ,have you seen a snail race!!!! that's the judicial system. don't get your hopes up. it will take lots of time. it will work but it takes longer than you can ever imagine

We really can't do anything in regards to building unless
At the madamus hearing, the judge orders a permit to be issued.
I think the hearing will be in October.
There go my dreams for being in a new house for Christmas.
I could take off all of my clothes and run down the street screaming with my hair on fire.
So frustrating!

me still thinks you can get farther faster batting those baby blues than sueing.
That lady justice statue, is standing their blindfolded, for a REASON!!
Atorneys ALWAYS tell you,,,you have the best case ever,,,then they say you should compromise,,then convince you to settle for a penny of what they claimed was right,,,
but their fee NEVER goes down. Their clock runs incrediblely fast!! AND they make intentional errors so they can rack up additional time fixing their screw ups!!
Keep us updated on this case,,,Hoping the best for you,of course,,,but prepare for the worst,,,OR more requirements they forgot to tell you the first time,,,and every step thereafter!!

I think we've exhausted every amicable means of settling this matter.
Trust me when I tell you, I hate to have to be put in this position.
There seems to be a problem with the local government with absolute power.
They think they have it.
It is my hope to just get the building permit and attorney's fees.
However, if this ever makes it to a jury, I would hope that punitive damages would be awarded.
As the Parish President told my husband, that if our neighbor hadn't of complained,
Our house would have been built by now.
There has to be some type of reckoning for denying citizens their right to due process.
If we settle out of court, this will not become public record.
Interrogatories are out.
I guess the best we can do is see where the chips may fall.
Shoot, if I thought it would work, I would rent a white horse,
Buy a long wig and do a Godiva number on them.
Of course, that may have just the oppositive effect (in my case)
My luck would be that a tick climbs off the horse onto me.
I will keep you posted.
I agree that monies spent do benefit the attorney,
But without any other recourse, (remember we had a written contract with the Parish that they broke),
We really are without any other options at this time.
It is devestatingly disappointing and disconcerting.
However, I feel better for at least taking a stand for my family's rights.
Whatever the cost may be.
