I went to an IME (independent medical examiner) court ordered by my husbands atty.

Believe this.


The Doctor writes in his report that he had a phone consultaion with two of my doctors.

I have spoken to both my doctors and they swear they never spoke with him. Especially without my consent they would not do so. HIPPA laws.

In the report he wrote the lyme disease test (western blot) was not positive by labs standards. I have a copy of the test and states on the test that it's positve by labs standards.


At the end of this report he includes that he did not perjur (sorry spelling) him self.

my question can I sue him for perjury? Do I go to a civil Atty. What can I do. He should not be allowed to do this to anyone.

There are also more false statements which I can prove because I have all my medical files/tests which he does not know I do.

I would sue!!! Hope you can afford to!

You had it right the first time... perjured or perjure for present tense.

I would certainly consult with an attorney, Fancy.

My guess is that if your doctors aren't willing to participate it'll go nowhere. Sorry to be a wet blanket.

Those medical records will come in mighty handy, though.

Thank you both. I called a Atty told me that it wouldn't go any where. His explanation made sense with the knowledge I do have in the court system.


That's okay. It will still be great for my case at hand today. Plus reporting him to the AMA.

Does **** me off that I can't prevent him from doing this to others but I will do what I can.

Reporting him to the AMA will do nothing at all. It is a trade association that looks out for the financial interests of doctors and does not handle complaints or have any enforcement power.

If you want to do something, file a complaint with the state medical board. Just don't involve any lyme doctors names in this.

I had an "exam" by a psychiatrist for my disability retirement case. He concluded that while I was depressed, it was mild and did not mean I couldn't teach school.

My memory was just fine. He asked me a couple of questions.

Then he gave me a several hundred question test to take home and send in when completed. In his reply to that he said he didn't understand why I couldn't complete it in a more timely fashion! [bonk]

It should never have left his office in the first place!

Result: my retirement case was denied. I appealed it all the way to the top with an attorney.

The state just rubber-stamped the original decision, despite mounds of evidence to the contrary and an expert witness, who had done neuro-psych testing on me explaining in detail why his tests didn't show what my problems were.

Funny how the same neuro-psych testing got me my SSDI!

Around the time of my SSDI approval my LTD company sent me for testing and they were prepared to deny me, I could tell by what they were saying.

Then I got news of my approval and surprise, they approved me! DUH!

They are out to save as much money as possible, despite evidence to the contrary.

I met a woman at my LLMD's office who taught in the same county as I did, has same dx. She was approved for her retirement. Go figure!

It's a $1,000 a month difference to me for the rest of my life. Kind of a big deal in my opinion!
