Have any of you used the FMLA for time off from work to accomodate Herxing symptoms? How did that pan out for you?

i know of a member who told me recently she was FIRED wile on fmla !!

just a fyi extreme stuation.

hope others can give you positive feedback on their own cases.

My understanding of FMLA is for you to take time off to take care of someone else in the family who has permanent illness that requires care but not yourself. You should take sick leave if you yourself are sick.

I use FMLA all the time when my wife needs me and never seem to have any problem, as long as it is authorized prior to the use of time.

I can see if someone uses FMLA for their own purpose, there might be a violation of the intent.

Someone PMed me saying that one could use FMLA for personal illness. Guess I only know part of the picture here.

Hi Gahagan,

I used FMLA when I first got sick (before I was diagnosed with Lyme). When my leave ran out, I was still too ill to return to my former job. My employer was very accommodating allowing me to take a different position with part-time hours.

I've not taken intermittent FMLA for herxing so i'm not sure how that works.

And your HR department should be able to tell you if you qualify and give you the paperwork required.

I found out I can apply for FMLA after the fact and it will be retro active. So, I think I may just see how things go, and deal with it if and when it happens. Of course, I'm expecting a phone call from my LLMD tonight, so I may have to rethink this depending on my new info.
