After my doctor dropped me and my wife as patients I got a lawyer...you never saw such a flurry of fax's from and to the eleven or so doctors that were involved with the Medical Group my doctor belonged to and all would have been guilty of missdiagnosing....

The legal secretary quit around the same time my lawyer lost some of my medical records and determined that my problems were preexisting....Gee do you think a deal was struck between my attorney and the medical group???
Then I was getting a lot sicker a lot of the time and did'nt have the energy to pursue it. I also had a suit going agains my employer that the EEOC said had evidence for discrimination but refused to take the case...what freakin good is that dept.

Anyway, good luck finding any lawyer that is willing to take a case where the test for the disease is not exactly the last word.
Also that lawyer would have a sickie that loses his or her memory from time to time, train of thought, energy....etc etc.

There have been some cases and I believe the railroad was involved however this isn't the forum to go into that...I believe you want to find it in the other forum that includes activities or activist news.

Good luck and if you do something and you need a witness we all would contribute I'm sure.

IMO, I believe that it would be very hard to seek legal action against a doctor's opinion that you don't have LD. Why? Because of all the supporting documentation for their side, er, view.

There has been several discussions of this, every now and again, over in General...you may want to try and search for that information. You might try the keywords, legal action, or something.

I would think that this would be a long hard battle, especially since Lyme Disease is a clinical diagnosis as supported by the CDC. I would put my energy into getting the proper treatment and seeking the "right" LLMD for you.
