since im going to be terminated on tuesday i did a search on this site for short term disability. why do employers fire employees after the 12 weeks are up if we supposedly have short term disability coverage for longer......i dont understand......i feel like im being punished for being sick and working of the company for 5 years means nothing to them. Im saddened by this and now wonder how many others have been fired where i work. Im super stressed tonite over all of this cant sleep its past 2AM........it just doesnt seem fair........how do you even get LTD when you cant get past the 12 weeks on std? i keep crying and this just really sux....i really dont know how im going to get better with this stressed dumped on me........and i was starting to see some improvement.......is there any legal action i can take?

I totally know what you're going through. I am going through soemthing similar, where the short term disability people dumped me for not being able to provide "objective" evidence of illness and my employer fired me *retroactively* by 3 months saying that I hadn't given them a doctor's note when I did.
What helped me TONS was to get hooked up with this yahoo group that someone on Lymenet posted about:
I had several responses to my question about my short term disability company and termination by my employer, by some extremely knowledgeable people.
After all this time I found out that what they (the disability company) did wasn't kosher and I am stunned. And I have to say it's also making me sad, hurt and angry that I would be treated this way by a company that I was very dedicated to.
But they of course are all looking at their bottom line, which I try to remember so I don't take it personally. But it's hard when the Lyme rage hits. It's 1 AM here and I was just lying in bed feeling angry about it.
So...I agree that that's really crummy but it seems like you have a good chance of getting it all straightened out.

P.S. I learned that those companies use tricks and use silly things as reasons to dump you. They do this even though it's not right and they get away with it because sick and tired people like us believe them when they say they are valiud in denying our claims.
Or, they count on us not having the knowledge or the strength to fight them when they deny benefits, even though what they're doing is wrong and they would lose in court.

Not knowing your whole story I can't comment intelligently, but if your company is like many they have hired another company to administrate short term disability claims. Their job is to find ways not to pay std.
It might be worthwhile for you to consult an attorney who is experienced in employment matters.

thanks i posted a msg on that website. It says it has been inactive for 7 days, but i hope someone will reply. I'm sorry that you had to go thru this to Alison. It seems some people who arent sick can stay on it forever and those who are sick get kicked off. Gotta love this country.
Monica- yes they hired an outsourced company..and i do try to remember they were hired to benefit my company and not me. I work in finance so i know how things go....im a liability, sadly i make less then most do at the company, but still a liability.
Im going to search all weekend online for a good attorney....then im going at this full force...i have to have some legal action available to me. i just cant believe companies are allowed to just fire after FMLA protection ends. I'm also going to review my company policy for term to see if they will have to pay my vacation. I have about 2 weeks owed to me if not more!!! Of course i wish i was well and i would tell them to shove it!!!!!!!!!!!!!!!!!
I was feeling better before all this hit the fan....i slept about 2 hours last nite and in minutes now have to call the LLMD and have someone drive me 2 hrs to his office. this really sux and is a HUGE set back health wise for me.

Disability insurance companies are known for dirty tricks. And you are probably right that your employer wants to cut their losses.
The Lyme Times had an article in the spring 2005 issue (number 41) written by a disability claims consultant. Not available yet in their on-line archives. Gives the email address of the consultant. Not sure exactly what this person does or charges, but maybe step one might be to get hold of this article - contact CALDA and order it.
Also, there is an email address and phone number for the consultant if you want it. And here is the website of this person: http://www.disabilityconsulting.net/
I never have understood why more people are not subscribing to the Lyme Times newsletter. Excellent info, well worth the cost. No point in everyone learning all this stuff the hard way, get informed with newsletter!

Where you been old-timer? (As in low member number, not age.) Nice to see someone else who has been around the lymenet scene as long as I have. Getting a complex about it. All these newbies keep flooding in, just endless supply of people who aren't getting diagnosed or treated correctly.

Here is a list of ERISA attorneys that a very kind person sent me whi is an attorney and answered my question on the forum. I am going to contact one of them myself for my issues with the disability company.
P.S. The forum has been active more recentlay than 7 days becuase I just got this response yesterday.
