Saw a Lyme doctor for only two months and it has taken me almost thirty days to get my records which I still don't have. Anyone know if there is a legal time limit from the date of request and does that request have to be written? I asked via phone first and then the next week sent a letter requesting my records. I was told last week they would be sent out by the end of the week. This week I am being told by next Wednesday. Unfortunatly, I have a doctors appt with a more ethical doctor that needs those records. The records where I paid a fortunte to IGENEX to test me over and over and over at the doctors request. The MD never even told me to expect an $800.00 every two weeks from IGENEX. Anyhow, anyone know if they have a legal time limit and when that clock starts ticking?

Does the new doc. absolutely need the records to see you or could you have them forwarded to the new doc after your first visit?
I have had docs take a long time to get records sent, especially the busy ones. Sometimes if you are upset with them when leaving they could take their time. You have a legal right to the records upon written request...time limit is another issue. You may have to ask again in writing via ceritfied mail. Sometimes there is an administration fee to get records...they are often incomplete and you have to go back and ask for missing pieces....get as much as you can
Sometimes the records are not as important as we think....if we have been keeping good records of what happened when, then most docs don't need detailed records and often don't read them anyway...write down everything in your medical history in chronological order with dates and names...then the doctor will have a good record to go by to get you started.... just a thought

Perhaps you can ask your new doc to request the records for you. I have found in the past that things seem to move faster from one doc to another via fax.

Yes, all places have their OWN request for medical release of info form!
So I'd advise you to go there and do this. While there, I'd also ask to REVIEW YOUR FILE there to get an idea what's in there and how detailed reports really are.
I asked for a copy going back 1 year plus specific tests of skin biopsies, etc. to take to my beginner LLMD. They gave me these.
There is NO FEE to get copies when going to another dr!
I then read thru them all and underlined/high-lited the most important stuff so new dr. could just skim reports when I was there with him.

The law varies state-to-state in the US. Drs are required to keep your records for a certain period of time, and you are entitled to copies during that time. If the doctor isn't cooperative, you can involve your state health dept. First, find out the law in your state and what you'd need to do.
I did this recently, and it's been a long process. Finally, the doctor is "helping" to track down records--rather than simply discarding certified mail, etc.-- though I have lost a year's worth of records in the administrative process as well as two years' SSDI because they needed his records, as he was my treating physician during that time.
Do call the health agency in your state capital to find out precisely what the law is where you are and the steps you'll need to take. Hopefully your dr's office will cooperate before you have to take too many of them -- for me each required waiting periods that added up (send letter, wait x weeks, have agency send letter, wait X weeks, etc...)
I still don't have them, and I'm still working with the state agency. I'm in NY, and the person who works for the state has been wonderful.

My doctors except for one, maybe two always put the records in a container on the door or a table inside the room. I say you make an appt. and if they leave the records there- pick them up and leave. If they don't- just show up and say I need to copy these now. Maybe that seems a bit coarse- but the records are yours. You paid for doctor's visits. You paid for the tests. It's all yours. I'm sorry things like this just burn my bottom. ~jackie

I don't think I need to show up with the police. They aren't nasty and I wrote a nice letter explaining why I was leaving and that I would like copies of my records. Yes, my new doctor does need them. Dr. B had me tested every damn time I came in and I would like to have copies of the info since I made quite a number of $800 Ingenex bills. I don't want to start over. I think you can understand. It shouldn't be a lot of info to copy. I myself only had 5 visits. So I guess I was tested all 5 times. My son was there for two treatments before I made the decision to change. I do think the doctor is very good but I have a problem waiting two to three hours to see him finally at midnight and of course his fees are more than anyone's out there. I guess we pay for the privledge......

Ahhhh, yes, I have heard about this doc.
How does seeing a doctor at midnight make any sense????
I have never heard of such a thing.
I just don't understand WHY doctors make you wait. I mean, we are paying...what is the point of an appointment then?

I think i wouldl show up in the middle of hte busiest part of his day...anounce to his staff you will wait for the file..and then announce to his patients waiting that you are leaving his office because of problems with his office.l..etc...tell his staff you will go into further details the longer they WAIT to give you your entire file...
watch how quickly they give it to you. I've had to do this with my kids pediatrician when i was switching to dr. jones..they refused..i stood in their waitign room adn proceeded to tell alltheir parents etc..how they botched testeing on lyme disease adn how sick my kids got, and how they almost died etc., and i was pulling my kids from their practice etc...
I was given my kids files within minutes..this was after a month long fight...AND htey had told me i had to pay $1 a page, which i refused to pay...and i didn't have to. they were happy to get rid of me from their waitng room. I had told them i would come back every day adn keep repeating my story to all their parents unless they turned itover..
if htey wanted to be nasty, i can play right back! and it worked. I was more concerned with getting my kids files so dr. jones could have what he needed to treat them properly. that was my main objective here....

Wow sounds like a lot of people go through this. I just don't understand why the doctors have to be so difficult.
