my Social Security Disability (SSDI) decision was "FULLY FAVORABLE" as they put it.
quote from Admin Law Judge (ALJ): "i found you disabled as of Nov05 b/c of chronic fatigue syndrome, lymme's disease (as he put it),
S/P right toe fracture and S/P on right shoulder so severe that you were unable to perform any work existing in significant numbers in the national economy."
good idea or bad.. notify the ALJ of the misspelling of Lyme. i think Social Security needs to get it right but i don't wanna push my luck. what do you think?
also, State Disability (SDI) for Lyme has been denied 3x. i'm preparing Writ of Mandate appeal.. do you suppose the SSDI decision will carry any weight towards the Writ?

As long as you get your money don't worry about educating SS.
I am hoping and praying that I get my letter in the mail for my hearing.
My appeal was filed over a year ago but they are backed up in NJ.
I haven't worked since 2005 so once I do get the hearing and get approved I will be in good shape.
Just trying to hang on until that comes.

betty, i am approved for SSDI.. the denials i'm referring to are with EDD's State Disability Insurance (SDI). i collected SDI for foot fracture and shoulder surgery but Lyme has been denied 3x..
SDI considers Lyme a continuation of previous claim.. they say i never recovered from shoulder injury and did not return to work. so untrue, i worked 12x post shoulder (3x with IV and twice post IV)
here's my understanding of various benefits:
STATE Employment Development Department (EDD) pays benefits under two programs:
1. Disability Insurance (DI or SDI): personal injury/illness unrelated to work. short term, ends when you recover or exhaust your account.
2. Unemployment Insurance or Compensation (SUI or SUC): is NOT paid to the sick or injured. you must be avail to work full or part-time. you have 52 weeks to collect 26 weeks of benefits.
SOCIAL SECURITY pays disability benefits under two programs:
1. Social Security Disability Insurance (SSDI): for insured workers, their disabled surviving spouses and children (disabled before age 22) of disabled, retired or deceased workers.
2. Supplemental Security Income (SSI): for people with little or no income or resources.
WORKERS COMP (WC): work related injury/illness filed through your employer. pays really well and can be both long and short term.
all benefits are based on your earnings.. SDI pays the highest rate.
i'm allowed to earn approx $900 per month while collecting SSDI. it is my understanding that DI & UI benefits collected thus far will get deducted from SSDI. i'm told i get one or the other not both.
