Hello, my husband has been off work on an FMLA. It is up as of Aug. 12.

He is an electrician working with 480 volts of electricity and moving machinery.

He has brain fog, migraines, fatique, assorted neuro symptoms, light and motion sensitivity, etc...

He is not physically or mentally capable of doing his job at this time.

His employeer told him today that after his 12 weeks they have no obligation to him what so ever.

BUT if Dr. C will write a letter saying he is well enough to work part time they will have a meeting to discuss the POSSIBILITY of letting him return to work temporarily in another position.

Problem #1 due to new attendence policy if he misses 6 days of work he is fired no questions asked, assuming they let him return to work in the first place.


Problem #2 if he gets the letter from Dr. C he will no longer be eligable for disability regardless of job outcome.


Problem #3 if he does not go back to work he is eligable for an additional 18 weeks disability MAXIMUM.

They are already fighting us on his claim. They don't seem to like what Dr. C. has to say about Lyme!


We don't know what to do. Some days he would be able to work half a day but certainly not every day. He isn't even driving except on rare occasions.

Should we take our chances with the job or the insurance company? One seems about as reliable as the other.

Seems like his employer is working with the insurance company so that they can both get rid of him. But I could be a bit paranoid there.

We would really appreciate any advice those of you who have "been there done that" could give.

Oh my your husbands employer has not read the law regarding FMLA.....they sure do have an obligation to him. You have to get an attorney on that one. My daughter took FLMA with her company and she has had it for 2 years. Yes one you use it up - you have to weight a period of time to start using it again....But they sure can't fire your husband because he used FMLA - hope you get it settled quickly...

But if he is really have symptoms - does your husband employers insurance benefits offer long term disability that might be something to explore.

My son in law was finally approved for Social Security Disability and Medicaid - hope this doesn't come down to that for you

My heart breaks - Remember you can get through this

Look up the ADA. He should be protected under that since a chronic illness is considered as a disability.
