We lost our suit for our daughters medication for lyme disease.

The judge ruled under ERISA that the plan adminstrator may choose do two things. THis will affect all ERISA cases

1) They may choose which parts of the case history they choose to use. In our case they chose to ignore the follwoing
a) Positive CDC test
b) Postiive PCR test
c) Dr. Jones treating phsyician notes
d) Our local treating ID notes
d) Our cardiologist and neurologist notes
e) Treating phsyician request to continue IV abx.

2) They were told that the claim file was not 'required to be released' what ERISA requires is that they release the "plan document"

THis is not a good thing for lyme patients. I no longer chat here, but felt you should know the outcome of this important trial.

Guess you know Cigna was one of those sued in that RICO lawsuit, by the "Tobacco lawyers." Got settlements too. However, not sure whether this was more for the docs than for patients. Here are some links to read about the story.

Note that the last one is the Cigna settlement summary. So, if they have been told to be fairer, how come you are now getting the shaft from them? Wonder if there is any contempt of court in this? Maybe another judge would see it differently--the one involved in this RICO case.
