Has anybody else filed a workers comp claim for lyme? I got lyme while doing stream assessments for my job, which I subsequently lost (I think in retailiation for having lyme and filing the suit). It is a huge battle to get my money from the insurance company even though I have a certified claim. I guess I am just naive...but I thought filing a workers comp claim would be a good thing for me. ha

In California, you usually need an attorney to get anywhere with a worker's comp claim. Even when both sides agree you were injured on the job.

In California, the worker's comp insurance works for the employer (gets paid by the employer). So they are on their side, not yours.

When I had a worker's comp claim (not Lyme related), I had to contact the Labor Board for direction on what state agency could help me and where to find an attorney.

As far as the Lyme issue, it shouldn't matter as long as everything is documented in your medical files (?)

I have a federal workers' comp claim that was approved right away, but my employer (who has no accountability) disagrees with the office of workers' compensation and won't sign or send in forms that have been requested of them, leaving me SOL.

Ecowoman and AP -

disability lawyers handle workman's comp cases too. They work on consignment, and don't take your money unless your case is won.

AP, your employer is probably breaking the law. Just the mention of a lawyer might get him to do what is required.
