Long story short, 3.5 years ago I got bit by tick. got the bullseye. went to the doctor, they diagnosed lupus.
Started seeing a LLD this year and just started antibiotics, actually just had my first herx. pretty mild.
with that said I found a lawyer who has been reviewing my case for about 6 weeks. I found a case out of MD a client won, and was curious if anyone has or knows about any more cases people have won for misdiagnosis of lyme disease when the obvious signs are there.
in my medical records its documented I had every early warning sign of lyme all of the big 4, and bullseye.
looking for more good news as this has been a wild emotional roller coaster since I got a lawyer to at at least review my records and take it serious.
Right now i'm 2 months into my statue of limitations, so i'm not trying to waste any time.

I pursued something similar last February. My story is a little different though. For me, I came down with bells palsy, went to the ER and was tested for Lyme disease.
Those test results were positive but I didn't find that out until a year later. It was part my doctor's fault part the hospital. The hospital's policy is not to send the results anywhere no matter the result. My doctor said he would follow up but he didn't.
Even with how bad this sounds, the lawyer I worked with told me that we would have to prove how I've been damaged and with lyme that's pretty difficult. I look fine from the outside and have continued working throughout so there aren't really any damages to point to.
Pretty damn frustrating but just because I didn't have a case doesn't mean you don't

I researched this topic years ago when I was very sick. Unfortunately, we have an uphill battle for several reasons.
The main is the CDC has "industry accepted standards" for diagnosis and treatment which we know is BS. The courts typically favor the physicians side anyway so we are at a complete disadvantage.
Most importantly, you will not win unless you can prove gross negligence. There are many very good doctors out there but there are many that are just uninformed, lazy, or just plain dumb. Someone had to graduate last in their Medical School yet we still call them doctors ....
